On February 20, 2026, the U.S. Supreme Court struck down all tariffs imposed under the International Emergency Economic Powers Act (IEEPA), potentially entitling U.S. importers to refunds of tariffs paid since these levies were first enacted in 2025.

In the wake of Learning Resources Inc. v. Trump, we have established a Tariff Refund Litigation Task Force to help companies considering whether to pursue refunds on tariffs paid under the now-invalidated IEEPA regime. With an estimated $130–175 billion collected since early 2025, the sums at stake are substantial.
For many importers, the decision to pursue tariff refunds will require weighing a number of considerations. Moreover, for those seeking to pursue refunds, the path forward is uncertain. Importers will likely need to take affirmative steps — including filing suit in the U.S. Court of International Trade — to recover what they are owed.
The CIT has indicated it may appoint a plaintiffs' steering committee and consolidate proceedings. Importers who file early will have the greatest ability to shape the process and protect their individual interests.
